- Payment is due on the 1st day of the month in which the term begins
and covers the term period following the payment due date.
If payment is not received by the due date, the membership may be
terminated at any time. If payment is not received by the 10th of the
month, a $5.00 late charge will be added to the account balance. If
the membership is terminated at any time during the pre-paid term period,
the pre-paid fee will not be pro-rated and no credit will be given.
- Cal.net may request
additional account information from the customer periodically. It is
the customer's responsiblility to notify Cal.net in writing of
any changes to the account information. Failure to provide any of the
above information to Cal.net constitutes grounds for
termination of the membership.
- Changes to a customers Cal.net account must be requested by the primary user on the account.
The customer may request changes to the account using one of the following methods:
- Users can request changes in an e-mail.
The user must include their verification information (Mothers Maiden Name & Customers Date of Birth)
- Users can request changes in a written letter or note, and must provide their
verification information.
- Users can request changes in person, and must provide their verification
information.
- Users shall ensure that use of
Cal.net's network services shall not disrupt Cal.net,
its associated networks or equipment forming part of Cal.net's
or the Internet's systems. Users shall not transmit any
communication where the meaning of the message, or its transmission
or distribution, would violate any applicable law or regulation or
would likely be offensive to the recipient thereof. Using Cal.net's
Internet connection in a manner that is disruptive,
damaging, unlawful, offensive, or intrusive as determined by Cal.net
shall be considered a breach of this Agreement and may result
in cancellation of service. Such interference or disruption includes,
but is not limited to: improper, harassing or offensive distribution
of unsolicited e-mail or advertising, excessive newsgroup
cross-posting, transmissions of any type or quantity that causes
disruption of service to others, propagation of computer worms,
trojans or viruses, use of the network to make unauthorized entry to
other computer networks, information, communications devices or
resources. Use of this service to violate the security of any
computer network, crack passwords or security encryption codes,
transfer or store illegal material including that deemed threatening
or obscene, or engage in any kind of illegal activity is expressly
prohibited. The installation, use, or implementation of any of the
following are prohibited: Robots, Bots, Mail Bombs, Syn Bombs or
Attacks, Back Orifice, Spamming of any kind, DOS attacks, etc. The
user agrees to indemnify and hold harmless Cal.net from any
claims resulting from your use of the service which damages you or
another party. Cal.net reserves the right to refuse and
delete at any time the content of any Web pages hosted on Cal.net
servers if the content of such Web pages contains
threatening, illegal, obscene or offensive material.
- Cal.net expressly disclaims any obligation to monitor its
customers and other users with respect to violations of this policy. Cal.net
has no liability or responsibility for the actions of any of its
customers or other users or any content any user may post on any web site.
- Reporting Non-Copyright Violations. Cal.net encourages users to
report violations of this policy by e-mail to: abuse@cal.net, including
in any such report the name of the offending domain (for example, xyz.com) and
the type of abuse (for example, spam, illegal acts, harassment, etc.) in the
"subject" field of the e-mail.
- Reporting Copyright Violations. Cal.net complies with the Digital
Millennium Copyright Act ("DMCA"). Cal.net encourages users to report
an alleged copyright infringement involving a user by sending a notice that
complies with the DMCA to:

- Remedies. If Cal.net learns of a violation of this Policy, Cal.net
will respond to the applicable customer and may, in Cal.net's
sole discretion, take any of the following actions, in accordance with the
severity and duration of the violation:
- Warning the Customer;
- Suspending the offending Customer from the Services;
- Terminating the offending Customer from the Services;
- Imposing fees or charges on the offending Customer account in accordance
with the applicable service contract;
- Removing the offending content; and
- Taking other action in accordance with this policy, the applicable service
contract or applicable law.
- The optional web page content
filtering service is provided "As Is". Under no
circumstances will Cal.net be held liable to client or anyone
else for any consequential, special, or indirect damages resulting
from the possession, use, or malfunction of this product, including
without limitation, damage to property and damages for personal
injury, even if Cal.net has been advised of the possibility of
any such damages or loss. The Internet contains unedited material,
some of which is sexually explicit or may otherwise be offensive to
you or others accessing the Service through your account. Cal.net
makes a dedicated attempt to filter these materials but makes
no express or implied warranties, representations or guarantees of
the proficiency level or the practical success of its efforts.
- Dialup accounts are not intended to
provide a continuous dedicated link. Such use is prohibited. Users
may not host a web, mail, chat, or any other type of server from a
Dialup account. Doing so will result in termination of the account.
- Except for software provided by
Cal.net, you are responsible for providing all computer
equipment and software necessary to access the Service. You are
responsible for the maintenance of any equipment or software not
provided by Cal.net. Except for certain products and services
specifically identified as being offered by Cal.net, Cal.net
does not control any information, products or services on
the Internet. Except for such identified content, all merchandise,
information and services offered, made available or accessible on the
Internet are by third parties who are not affiliated with Cal.net.
You assume total responsibility and risk for use of the
Internet by you or other users of your account. Cal.net shall
not be liable for any costs or damage arising directly or indirectly
from any transaction you affect through the Service or the Internet
generally.
- Cal.net makes no expressed or
implied warranties regarding this service. Cal.net assumes no
responsiblity for damages caused by but not limited to interruptions
in service whether caused by Cal.net or not, or the quality or
substance of the data being delivered to the customer or being sent
by the customer through Cal.net. You agree to indemnify and
hold harmless Cal.net from claims related to your use of this
service which causes damages to you or any other party. Cal.net
does not warrant that the service provided will be
uninterrupted or error-free or that any information, software or
other material accessible on the Internet is free of viruses, worms,
Trojan horses, unsolicited e-mail or other harmful components. Cal.net
has no control over materials that are posted on the
Internet, the content of the Internet, and accepts no responsibility
for such materials. Use of any information obtained from the Internet
is at your own risk.
- Information transmitted through
Cal.net and through the Internet in general is not
confidential. Therefore, Cal.net can not and will not
guarantee privacy or protection of any user. We reserve the right to
monitor any user's transmissions when deemed necessary for providing
proper service and/or to protect the rights and property of the
Company.
- Cal.net is not responsible
for any telephone charges incurred by the customer, whatsoever,
including long distance or toll charges incurred. The customer is
solely responsible for determining which dialup numbers are within
the customer's local calling area, and for using the proper dialup
numbers when accessing Cal.net.
- No advice or information given by
Cal.net or its respective employees shall create a warranty or
guarantee of any type.
- All DSL accounts require a year commitment for the first 12 months. Any cancellation
of a DSL account within the first 12 months will be subject to an early termination fee of $150.
- For all DSL and Wireless customers, if the account is disabled for non-payment
and is later re-instated, a $25 re-activation fee will be assessed to said account.
- For all T1 customers, all accounts require a commitment period as specified in each customer's individual
service contract. Early termination fees are equal to the number of months remaining on the service contract
times the usual monthly fee. Installation & activation charges are non-refundable. Reinstatement after being disabled
due to non-payment incurs a $50 reactivation fee.
- These membership terms and
conditions are subject to change without notice. The most up-to-date
copy of this document can be found at http://www.cal.net/members_area/cal-net-terms_and_conditions.php. You
are encouraged to check this document frequently so that you may be
informed of any changes. If you do not agree to these terms and
conditions, please notify Cal.net at 530.672.1078 during
normal office hours so we can terminate your account. Failure to
notify Cal.net and/or continued use of your account after a
